ORDINANCE FOR THE RULES AND REQUIREMENTS FOR THE PRODUCTION OF REGIONAL WINE

Section I.
General Provisions

Art. 1.

The ordinance establishes rules and requirements for the production of regional wines.

Art. 2.

Regional wine is table wine, which is permissible to use a geographical indication approved under the Ordinance.

Section II.

Requirements to be met by regional wines


Art. 3.

The production of regional wines with the following requirements:
1. Regional wine must have:
a) natural alcoholic white wines - at least 8.5 percent (vol%) and for red wines - at least 9 vol. %;
b) the actual alcoholic content of white and red wines - at least 10 vol. %;
c) the total strength - not less than 15 vol. %;
d) the content of titratable acids - at least 4.5 g / l expressed as tartaric acid;
2. maximum yield of grapes per hectare does not exceed 1300 kg;
3. Wine obtained from 100 kg grapes, not to exceed 70 l;

4. is obtained from grapes coming from wine-growing area as defined in Art. 6.

                                                       Rules for the production of regional wines

Art. 4.

(1) Products which can receive regional wines are: fresh grapes, grape musts, partially fermented grape must, rectified concentrated grape musts, new wines in fermentation and wines suitable for the production of table wines.
(2) The products of para. 1 is derived from specified under the ordinance of art. 24, para. 1 of the wine and spirits authorized and recommended varieties.

Art. 5.

(1) regional wine is produced in the wine region whose name it bears.
(2) Regional and wine is representing a blend of wines made from grapes from various vineyard areas, provided that 85 percent of wine in the vineyard region whose name it bears an appropriate regional wine.
(3) The geographical indication used to indicate the regional wine should be associated with wine-growing region from which it originates wine.
(4) Traditional term can be used as a geographical indication of wine-growing region after the establishment of regional wine under Art. 8-14.
(5) The traditional name, which is used as a geographical name of the vineyard area may not coincide with traditional specific terms and additional specific traditional names.

Art. 6.

Wine-growing regions are determined on the basis of administrative-territorial division of the territory of Bulgaria. The boundaries of the wine-growing regions may coincide with the boundaries of administrative-territorial unit to cover more than one administrative-territorial unit or refer to a specific area of production, or valley of the River Valley and others.

Art. 7.

The rules and requirements for production of each regional wine is determined in order for his approval.

Art. 8.

(1) To promote regional wine producer or manufacturer shall submit an application to the regional Vine and Wine Chamber (RLVK) in whose territorial range falls completely or most of the wine region where wine is produced.
(2) The application shall state:
1. trade name, type and type of wine;
2. name of manufacturer, seat and address;
3. place of production;
4. description of the boundaries of the wine-growing region;
5. variety or varieties of grapes, producing wine in the designation of more than one variety is noted the percentage of each variety;
6. data on the requirements of Art. 3, items 1-3.

Art. 9.

(1) Within 14 days of application RLVK checked the documents and irregularities in writing notify the applicant / applicants for their removal within 7 days.
(2) Within one month of expiry of the period under par. RLVK 1 summarizes all the applications and manufacturers prepare for the general case stated regional wine containing statement regarding compliance with the requirements of Art. 3 and the data of art. 8, para. 2.
(3) The period referred to in para. 2 RLVK affixed to the building as headquarters for all data file requested for regional wine and publish a notice in one national and one local newspaper for the received application for approval of regional wine. The notification shall specify the place where any person may refer the case and the period can not be shorter than 14 days in which any person may make suggestions and additions.
(4) Where the proposals and additions RLVK compiles them and includes them in the general case of para. 2.
(5) Within 14 days of the deadline under par. 3 RLVK send the file to the Committee on the quality wines of art. 44 of the Ordinance for the conditions which must meet the quality wines psr, the manner and procedures for their approval, adopted by Ordinance № 53 of the Council of Ministers of 2000 (promulgated, SG. 31 of 2000; am. No.. 82 of 2001).

Art. 10.

(1) Commission on Art. 9, para. 5 file review within one month of receiving it and if necessary carry out spot checks to ascertain the circumstances under art. 8, para. 2. For the check is drawn.
(2) The gaps in the file and / or a discrepancy between the documents and the results of the examination committee shall notify the applicant in writing and give time for their removal, which may not be longer than 14 days.

Art. 11.

(1) The rectification of irregularities within the term of art. 10, para. 2, the Commission leaves the case without consideration.
(2) If within 3 months of the notification under Art. 10, para. 2nd applicant fails to remedy the deficiencies, the committee recommends that the Minister of Agriculture and Food to refuse the establishment of regional wine.
(3) The refusal of the Minister of Agriculture and Food to establish regional wine may be appealed under the Act for the Supreme Administrative Court.

Art. 12.

(1) Within 14 days after removal of the deficiencies of art. 10, para. 2 The Commission considered the case and prepare a proposal to the Minister of Agriculture and Food to promote regional wine.
(2) The proposal in para. 1 shall apply the corresponding file.

Art. 13.

(1) Within 14 days of receiving the proposal from the Minister of Agriculture and Food approved regional wine act to promote the model in Annex.
(2) The Act to promote the regional wine is published in the unofficial section of the Official Gazette and may be appealed under the Act for the Supreme Administrative Court.
(3) Amendments in order to promote regional wines are made pursuant to Art. 9-13.

Art. 14.

(1) The case for each approved regional wine store in the Executive Agency on Vine and Wine (IALV).
(2) The Executive Agency on Vine and maintain an electronic database established regional wines.
(3) The Executive Director of IALV annually by January 30 published in the unofficial section of the Official Gazette a list of approved regional wines.

                                                                 Section IV.
                                                                    Control

Art. 15.

(1) (Prev. text of art. 15 - SG. 3 of 2008) Control of the production of regional wines are made by officials appointed by decree of the Executive Director of IALV.
(2) (New - SG. 3 of 2008) to perform the quality control of regional wines persons under para. 1 samples for physico-chemical and microbiological analysis under chapter five of the Ordinance for supervising and coordinating the control of wines, spirits, distillates and spirits, CM Decree № 232 of Council of Ministers of 2005 (SG pcs. 99 of 2005)

                                                Transitional and Final Provisions

§ 1. Regional wines unstable under the Ordinance on the market within one year after its entry into force. After this period they are offered as table wines.
§ 2. (1) Until the demarcation of the wine-growing regions for the production of regional wines are used within the settlements Annex № 3 of art. 34 of the Ordinance on the designation and presentation of wines, spirits and products of grapes and wine, adopted by Ordinance № 55 of the Council of Ministers of 2000 (promulgated, SG. 31 of 2000, amended. And supplemented . No.. 53, 59 and 82 of 2001).
(2) Pending the establishment of regional wines, but not later than one year from the enactment of the ordinance to designate wines of regional geographic names used in Annex № 3 of art. 34 of the Ordinance on the designation and presentation of wines, spirits and products of grapes and wine, including the names "Danube Valley, the Black Sea region", "Rose Valley", "Thracian Valley and Valley of the Struma.
§ 3. Ordinance is adopted pursuant to Art. 7 of the wine and spirits.
§ 4. The implementation of this Ordinance is assigned to the Minister of Agriculture and Food.
